1. SERVICE: Federal Rule of Civil Procedure 4(m) requires service of summons and complaint to be perfected upon Defendants within 90 days after the filing of the complaint. Unless service is waived, proof of service must be made to the Court by filing the server's affidavit. If a Defendant waives service, notice of the same shall be filed immediately. 1:26-cv-25623-LFL09/29/2609/29/2612PAPERLESS ORDER granting in part and denying in part [11] Plaintiff's Motion for Appointment of Counsel to Serve as Guardian Ad Litem or in the Alternative, Extension of Time to Retain Counsel for Minor J.A.V.

Plaintiffs' request for the appointment of a guardian ad litem is DENIED without prejudice to renew, if appropriate, at a later time. Guardians ad litem are generally appointed to represent the interests of a minor when there is a conflict between the minor and a parent or legal guardian, usually during settlements. However, as one court explained, the "appointment of a guardian ad litem would not change the fact that [a parent] is still attempting to impermissibly proceed pro se on behalf of minor children." Howard v. United States, No. CV 121-118, 2021 WL 5458434, at *1 (S.D. Ga. Oct. 27, 2021), report and recommendation adopted, No. CV 121-118, 2021 WL 5456967 (S.D. Ga. Nov. 22, 2021).

Plaintiffs have made diligent efforts to obtain counsel for J.A.V. but have, thus far, been unsuccessful. The Court finds good cause to grant the requested 30-day extension of time. Accordingly, by Thursday, October 29, 2026, an attorney must file a notice of appearance on J.A.V.'s behalf. The failure of an attorney to enter a timely appearance in this case on behalf of J.A.V. will result in an Order dismissing without prejudice the claims asserted on behalf of J.A.V.

Additionally, the Court will refer this case to the Volunteer Attorney Program so that a volunteer attorney may accept the representation on a pro bono basis if so desired. Because there is no requirement that a volunteer attorney accept the referral, Plaintiffs must continue their efforts to search for an attorney for J.A.V.

The Clerk of Court is instructed to MAIL a copy of this Order to Plaintiffs and file a notice of compliance on CM/ECF. Signed by Magistrate Judge Lauren Fleischer Louis on 9/29/2026. (mk01) (Entered: 09/29/26)
