In the Motion, Plaintiff moves to substitute Attachment A with a revised version and correct the employment start date referenced in the pleadings (DE 33). Because Plaintiff is proceeding pro se, the Court construes this request as a motion for leave to amend under Federal Rule of Civil Procedure 15. Under Rule 15, "[t]he court should freely give leave when justice so requires." Fed. R. Civ. P. 15. In this instance, allowing Plaintiff to make the requested corrections to the operative complaint serves the interests of justice, as this case is in its infancy and no defendants have yet appeared. Accordingly, Plaintiff's Motion to Substitute (DE 33) is GRANTED. Plaintiff may file a Third Amended Complaint by June 29, 2026. Signed by Magistrate Judge Ellen F. D'Angelo on 6/15/2026. | 1:26-cv-22405-EFD | 10/09/26 | 10/09/26 | 95 | PAPERLESS ORDER. This Cause is before the Court on Plaintiff's Motion for Leave to File Fourth Amended Complaint filed on September 22, 2026 (DE [81]) and Plaintiff's Notice of Corrected Filing Entry and Request for Immediate Docket Association filed on October 6, 2026 (DE [87]). In the Notice, Plaintiff states that a docketing error occurred when filing her Motion for Leave to Amend resulting in her Proposed Fourth Amended Complaint being filed separately on the docket, rather than as an exhibit to the Motion (id. at 1). Plaintiff requests that the docket be corrected to reflect that the Proposed Fourth Amended Complaint is an Exhibit to the Motion for Leave to Amend. In light of Plaintiff filing an Opposition to Defendant's Motion to Strike and Cross Motion for Leave to Amend (DE 92) on October 8, 2026 renewing her request for leave to amend and attaching the Proposed Fourth Amended Complaint as an exhibit, Plaintiff's Motion for Leave to File Fourth AmendedComplaint (DE 81) and Plaintiff's Notice of Corrected Filing Entry and Request for Immediate Docket Association (DE 87) are DENIED AS MOOT. The Court construes Plaintiff's Opposition to Defendant's Motion to Strike and Cross Motion for Leave to Amend (DE 92) as a new motion for leave to amend, which remains pending for the Court's consideration. Accordingly, Defendants have until October 22, 2026 to file a response in opposition and Plaintiff has until October 29, 2026 to file a reply, if any. Signed by Magistrate Judge Ellen F. D'Angelo on 10/9/2026. (lpo) (Entered: 10/09/26) |

| 1:26-cv-22405-EFD | 10/16/26 | 10/16/26 | 100 | PAPERLESS ORDER. This Cause is before the Court on Plaintiff's Motion for Leave to File a Sur-Reply in Opposition to Defendants' Motion for Leave to File a Counterclaim filed on October 14, 2026 (DE [98]). Plaintiff seeks leave to file a sur-reply on the basis that Defendants reply contains factual misrepresentations and misapplied case law. Under Local Rule 7.1(c), briefing consists of the motion, a response in opposition, and a reply. Any further briefing requires leave of Court.See S.D. Fla. Local Rule 7.1(c). However, Plaintiff has not demonstrated that Defendants advanced new arguments not set forth in the initial Motion. See DEF.T.C. v. 1st Guar. Mortg. Corp., No. 09-CIV-61840, 2011 WL 1226213, at *3 (S.D. Fla. Mar. 30,2011) (finding that "plaintiff's replies did not raise any new issues that would justify a sur-reply."). And to the extent that the Court needs issues clarified, it will call for supplemental briefs from the Parties in its discretion.Since Plaintiff fails to identify a valid reason to permit a sur-reply, additional briefing is not warranted. See First Specialty Ins. Corp. v. 633 Partners, Ltd., 300 F. App'x 777, 788 (11th Cir. 2008) ("A district court's decision to permit the filing of a surreply is purely discretionary and should generally only be allowed when 'a valid reason for such additional briefing exists, such as where the movant raises new arguments in its reply brief.'" (citation omitted)). Accordingly, Plaintiff's Motion for Leave to File a Sur-Reply in Opposition to Defendants' Motion for Leave to File a Counterclaim (DE 98) is DENIED. Signed by Magistrate Judge Ellen F. D'Angelo on 10/16/2026. (lpo) (Entered: 10/16/26) |
| 1:26-cv-22405-EFD | 10/16/26 | 10/16/26 | 101 | PAPERLESS ORDER. This Cause is before the Court on Plaintiff's Motion for Leave to Tender a Physical USB Drive for In Camera Inspection (DE [93]) filed on October 8, 2026. In the Motion, Plaintiff asks the Court for leave to tender a physical USB drive for in camera inspection to review documents produced by Defendants in discovery in an allegedly unorganized manner. Pursuant to Local Rule 5.1(d), the Court does not accept factual information untethered to any motion pending before theCourt. Furthermore, "[t]he Court has neither the time nor the resources to review document production in cases unless it determines in very specific and limited circumstances that such an in camera inspection is necessary." United States v. Bahrs, No. 05-CIV-00138, 2006 WL 2578706, at *1 (N.D. Fla. July 17, 2006). Additionally, although unclear, Plaintiff's Motion appears to request several independent forms of relief in a single motion, including sanctions under Rule 37, an in-person status conference pursuant to Rule 16, and a protective order pursuant to Rule 26(c). The Court notes that "combining separate forms of relief into one motion[] is improper." Shaik v. TokMedia Enters., LLC, No. 25-CIV-22308-LMR, 2025 WL 5260857, at *2 (S.D. Fla. Nov. 12, 2025); see also Woliner v. Sofronsky, No. 18-CV-80305, 2018 WL 8787752, at *1 (S.D. Fla. July 19, 2018) (denying omnibus motion containing two separate and distinct requests for relief and noting that such motions "unnecessarily complicate" the case). Accordingly, Plaintiff's Motion for Leave to Tender a Physical USB Drive for In Camera Inspection (DE 93) is DENIED WITHOUT PREJUDICE. To the extent Plaintiff seeks to renew any request for relief, she must do so in accordance with the applicable rules. Signed by Magistrate Judge Ellen F. D'Angelo on 10/16/2026. (lpo) (Entered: 10/16/26) |
| 1:26-cv-22405-EFD | 10/16/26 | 10/16/26 | 102 | PAPERLESS ORDER. This Cause is before the Court on Plaintiff's Expedited Urgent Motion to Correct Docket Asymmetry (DE [99]). In the Motion, Plaintiff contends that the Court's October 9, 2026 Order (DE 95) incorrectly construed Plaintiff's Opposition to Defendant's Motion to Strike and Cross Motion for Leave to Amend as a new motion for leave to amend. Plaintiff further states that her Response in Opposition indicates that Defendants do not oppose the filing of a Fourth Amended Complaint. After reviewing Defendants' Motion to Strike and Plaintiff's Opposition to the Motion to strike, it is unclear whether Defendants oppose Plaintiff's request for leave to amend the operative complaint. Nevertheless, the Court will permit Plaintiff to re-raise her request for relief by filing a new motion with the proposed amended complaint attached. Accordingly, Plaintiff's Expedited Urgent Motion to Correct Docket Asymmetry (DE 99) is GRANTED IN-PART andDENIED IN-PART. Plaintiff may file a renewed motion for leave to amend by October 30, 2026 with a certificate of conferral that clearly indicated Defendants' position on the motion. If Defendants oppose the motion, they shall file a response by November 6, 2026. If Defendants oppose, Plaintiff may file a reply by November 13, 2026. The proposed amended complaint shall be attached as an exhibit to the motion for leave to amend and should not be filed separately on the docket. Furthermore, Plaintiff should include all allegations and causes of action she intends to bring in the proposed fourth amended complaint. In the future, affirmative requests for relief must be made in separate motions, not in a response to an opposing party's motion. See Est. of Diamond by Diamond v. ITM TwentyFirst Servs., LLC, No. 21-80339-CV, 2021 WL 7630484, at *1, n.1 (S.D. Fla. June 17, 2021) ("not[ing] that [party]'s [c]ross-[m]otion raised in the context of its [r]esponse [was] procedurally improper, as '[a] request for a court order must be made by motion,' not in a response memorandum to an opposing party's motion" (quoting Fed. R. Civ. P. 7(b)(1)). Lastly, this is the final time that the Court will remind Plaintiff about filing emergency or expedited motions that do not comply with the Local Rule 7.1(d) and do not warrant expedited treatment. Plaintiff is admonished that the further filing of non-compliant, expedited motions will result in sanctions, which may include dismissal of this action in the Court's sound discretion.
