| 9:24-cv-81305-RAR | 01/15/25 | 01/15/25 | 14 | PAPERLESS ORDER denying Plaintiff's [13] Motion. When the Court granted Plaintiff's [3] Motion for Leave to Proceed in forma pauperis, the Court imposed a one-time lien of $405.00. See Order, [ECF No. 4], at 23. Certainly, the Court cannot collect a filing fee in excess of "the amount of fees permitted by statute for the commencement of a civil action." 28 U.S.C. section 1915(b)(3). So far, the Clerk has not posted receipt of any portion of the fee from Plaintiff's inmate account. See generally Docket. Furthermore, Plaintiff has "presented no evidence" of a second lien or "that he paid excessive filing fees to the district court." O'Berry v. State Att'ys Off., 241 F. App'x 654, 659 (11th Cir. 2007). Plaintiff's Motion is therefore DENIED without prejudice. Plaintiff is free to refile his motion with attached exhibits reflecting an unauthorized second lien on his inmate account should one exist. Signed by Judge Rodolfo A. Ruiz, II on 1/15/2025. | 9:24-cv-81305-RAR | 11/02/25 | 11/02/25 | 60 | PAPERLESS ORDER denying without prejudice Plaintiff's [58] Motion for Leave to Amend. Plaintiff has already been permitted to amend his pleading once as a matter of course. See Amended Complaint, [ECF No. 7]. Plaintiff has far from established why justice requires granting him leave to file a second amended complaint. His proposed second amended complaint appears to reassert claims that arose between 2022-2023 against existing and previously terminated Defendants, as well as new claims arising in July 2025. See Proposed Second Am. Compl., [ECF No. 58-1]. The Court sees no reason why Plaintiff could not have similarly asserted his live claims in his Amended Complaint—which he filed nearly a yearago before the Court exhausted large efforts to serve all Defendants on his behalf and at the public's expense—and why Plaintiff's proposed new claims (based on an entirely different medical need) are properly joined in this action. See generally id.; see also Maynard v. Bd. of Regents, 342 F.3d 1281, 1287 (11th Cir. 2003) (stating that the denial of a motion to amend was proper where "there seems to be no good reason why [the plaintiff] could not have made the motion earlier"). Moreover, the Court has yet to adjudicate Defendants' recently filed [59] Motion to Dismiss his Amended Complaint. See generally Mot.; see also Fed. R. Civ. P. 15(a)(2). For these reasons, the Court DENIES Plaintiff's Motion for Leave to Amend without prejudice. Signed by Judge Rodolfo A. Ruiz, II on 11/2/2025. (gan) (Entered: 11/02/25) |

| 9:24-cv-81305-RAR | 04/30/26 | 04/30/26 | 76 | PAPERLESS ORDER denying [73] Motion for Leave to Appeal In Forma Pauperis ("IFP Motion"). Motions to appeal in forma pauperis are governed by 28 U.S.C. § 1915 and Federal Rule of Appellate Procedure 24. See Woodson v. Sec'y Dep't of Corr., No. 02-21921-Civ, 2020 WL 5819808, at *2 (S.D. Fla. Sept. 29, 2020). A proper motion to proceed in forma pauperis on appeal requires (1) an affidavit that (2) shows in detail the party's inability to pay or to give security for fees and costs, (3) claims an entitlement to redress, and (4) states the issues that the party intends to present on appeal. See Fed. R. App. P. 24(a)(1). In his IFP Motion, Plaintiff handwrote the required affidavitof indigency. See generally IFP Motion, [ECF No. 73]. Yet, because Plaintiff has neither claimed any entitlement to redress, nor identified any issues he intends to raise on appeal, his IFP Motion fails to comply with Federal Rule of Appellate Procedure 24(a). See Johnson v. Dixon, No. 19-cv-23494, 2023 WL 11885180, at *1 (S.D. Fla. Feb. 10, 2023) (denying motion to proceed in forma pauperis on appeal where petitioner "fail[ed] to mention any of the issues that [he] intend[ed] to present on appeal" (cleaned up)). The IFP Motion is therefore DENIED as legally insufficient. Signed by Judge Rodolfo A. Ruiz, II on 4/30/2026. (gan) (Entered: 04/30/26) |

| 9:24-cv-81305-RAR | 06/01/26 | 06/01/26 | 80 | PAPERLESS ORDER striking Plaintiff's [77] Motion for Leave to Appeal In Forma Pauperis ("IFP Motion"). Plaintiff filed an IFP Motion requesting that the Court "waive the in forma pauperis fee's entirely." IFP Mot., [ECF No. 77], at 1. Critically, Plaintiff further noted that if the appellate filing fee could not be entirely waived, "[he] would not want to be billed at all... and would rather drop the case." Id. Motions to appeal in forma pauperis are governed by 28 U.S.C. § 1915 and Federal Rule of Appellate Procedure 24. See Woodson v. Sec'y Dep't of Corr. , No. 02-21921-Civ, 2020 WL 5819808, at *2 (S.D. Fla. Sept. 29, 2020). Under 28 U.S.C. § 1915, a prisoner who "files an appeal in forma pauperis... shall be required to pay the full amount of a filing fee." 28 U.S.C. § 1915(b)(1) (emphases added). Courts collect the fee from indigent prisoners through installment payments. 28 U.S.C. § 1915(b)(2). Thus, the Court has no discretion under § 1915 to waive a prisoner's filing fee in its entirety. See generally 28 U.S.C. § 1915. Plaintiff's [77] IFP Motion is therefore STRICKEN. Plaintiff may, if he wishes, file a renewed IFP Motion on or before June 15, 2026, with the understanding that, if granted, he remains obligated to pay the appellate filing fee in full. Signed by Judge Rodolfo A. Ruiz, II on 6/1/2026. (mro) (Entered: 06/01/26) |
