Waterford has filed a response in opposition [119]. With this motion, Plaintiff seeks to compel production of communications regarding Plaintiff and better responses to related requests for production. The motion is denied for three reasons. First, the motion is procedurally defective, as it was filed after the September 5, 2025, discovery deadline. Wademan v. United States, 2017 WL 7794321, at *1 (S.D. Fla. May 3, 2017) ("The Court does not entertain motions to compel filed after the discovery cutoff because relief cannot be granted now that the discovery period is closed, unless there are compelling reasons to do so (e.g., violation of an earlier discovery order)."). Second, Plaintiff's contentionthat Waterford's overbreadth objection to RFP Nos. 4(a) and 12(d) is improper is untimely. Local Rule 26.1(g)(2)(A) requires a party to submit discovery disputes within 28 days of service of the written responses or objections that are the subject of the dispute. Waterford served the responses at issue on July 21, 2025, so Plaintiff had until August 18,2025 to bring this issue to the court. Plaintiff filed a motion within that period but subsequently withdrew it. Accordingly, the time to bring this issue to the court has passed. Third, to the extent Plaintiff argues she only learned of certain production deficiencies in depositions at the end of the discovery period, that argument is unavailing because Waterford subsequently supplemented its production with responsive documents, DE 119 at 12, and some of the deficiencies Plaintiff identifies concern communications which she authored and already possesses, DE 74 at 9. See In re Disposable Contact Lens Antitrust, 329F.R.D. 336, 431 (M.D. Fla. Dec. 4, 2018) ( "[C]ourts routinely 'decline[] to compel production of documents in the hands of one party when the material is equally available to the other party from another source.'") (quotation omitted); Valenzuela v. Smith, 2006 WL 403842 at *2 (E.D. Cal. Feb. 16, 2006) ("Defendants... will not be compelled to produce documents that are equally available to plaintiff.").
